should be tight. i couldn't breathe properly in my BKS when i first got it let along try and stand up straight without it pulling down.
Takes bout 20mins to get into/out of aswell. It'll loosen up even if it does seem too tight

Bear in mind that a 1 peice suit is deliberately cut to fit your body shape when you are sitting on the bike. They are not designed to be comfortable when walking around, or even standing.
Obviously only you know how they feel when you are wearing them, but if two seperate people in two seperate shops have advised you that 40 is too big it may just be a case of breaking them in and getting used to them (of course that does depend on which shops are involved as some are better than others....)
One tip I would suggest having fitted and sold leathers for many years is to treat them with a good quality leather feed - I personally use Nikwax - as this will increase the moisture in the leather making them more supple and aid stretching. Do NOT do this if you are planning to take them back to the shop though, as they will not look like new once treated, so the shop will probably not take them back.

i took them back yesterday, so thats a total of 400 miles in total in 2 days for these leathers if a 42 is too big and a 38 is too small 40 has gotta be the right ones,,ive found the last set known to man and ordered it,,will have to see what the fit is like when they come,as the shop is too far to travel......i went to another shop and tried on the spada predator black suit and i must say that that suit is lush,,,beautifull fit and the leather is supersoft it was like touching my face after a shave,,,so im gona get them at some point aswell for the more comfort riding,even though i did look like a gimp without the mask

To be fair depends on what you're using them for, only use my one piece for track riding, it's rather snug to say the least & I always need a hand getting them off with the back protector in.
I believe you have them like this to hold all the vital bits in place in case of an off, just ask bunny re a mutual aquaintance and it keeping bits attached, i.e lower legs
