Speed Camera question ...

A mate of mine was flashed just after buying a new bike. Now when he was flashed he wasn't insured on the bike becuase he hadn't sorted it yet ... The ticket came through later than the required amount of days so should he contest this.

Bearing in mind if he does he could be pulled up on the fact he wasn't insured to ride the bike.

Or should he take the 3 points and fine?

Legally the police have to get the NIP - notice of impending prosecution to you within 14 days.

if its after that then you should be able to contest it and get it chucked out.

there are many useful webites with this sort of information including the D&C camera partnership site.

it obviously a little rocky because of the insurance issue but its also worth checking the exact time the insurance cover started as it can be instant or back dated if necessary - depends what insurance company it is.

if it is within the 14 days then the next step is to ask for the photographic evidence as legally they have to provide this under Human Rights Laws - as everyone has the right to defend themselves and you are unable to do this with out seeing and getting the evidence checked yourself.

again it depends how pushy you are but you stand a very good chance of getting it chucked out of court if they can not provide evidence.

sometimes just requesting evidence and getting in touch with them is enough to stop the process as its too much hassle for them - but that depends on the speed that the bike was ALLEGEDLY doing.

hope this helps but speed cameras are a bit of a mind field - speed cameras and bikes are even muddier!!!

It was definately not within the 14 days, but because of the insurance thing he doesn't want to contest because he thinks they'll [censored] him on that as well.

It was pissing down, hed missed the camera some jack ass car driver was right up his arse in a 30 so he blipped the throttle to put a gap between him and the car but got flashed, couldn't have been doing that much more than the speed limit but enough to get [Censored].

at the end of the day there is no excuse for speeding....
its all about choices--
he made the decision to speed
he made the decision to ride with no insurance

luckily for him he has the choice to take 3 points and fine and learn a lesson.
he will get away without been caught without insurance

more importantly no one was harmed !!!

my friend shaun used to be able to trick a speed camera. he used to lay on the tank and put his feet over the numberplate on purpose. he used to do it about 20 or so times a night at the same place at st.blazy. bloody good laugh. never got done once

i know its harsh,but for once got to agree with chris on this one, and yellowsvr. (wont happen again

) but worth going to the cop shop and just ask what might happen. say hes there on behalf of a mate. and say, look this ticket was sent after the 14days , blah blah blah, does anything more need to be done officer, blah blah blah.

don't want to find myself becoming to "agreeable" with someone who is willing to "smoke" someone for a ride of their bike !!

I'd fight it all the way, regardless of the circumstances if it we're me.

Bit daft riding the bike before you'd arranged insurance but these things happen, not my place to judge ;)

it is "daft" to ride without insurance
even dafter to put yourself in a vulnerable position by riding through a speed trap in that position..

i'm not "judging" --leave that to the magistrate

They have to post it within 14 days, so how close was it? If its post marked within a couple of days then the police can enforce it.

Did he already have another motorcycle insurance policy

If he does, it is likely that insurance will provide the minimum cover for the new vehicle in the "transition" from one to the other.

Does he have a car

If so that policy is likely to provide 3rd party cover whilst driving another vehicle not registered in his name.

If he contests the ticket, why would they ask for insurance details

That said, as others have already commented - you make the choice to break the law, you have to accept the penalty of being caught

Speeding ain't the end of the world, but if they get a sniff of no insurance he will be well and truly f****d (and rightly so)

NO insurance company appreciates a driving without insurance wrap on the licence

Depending on the state of his licence (and the state of insurance cover), it may be best to roll with the punch, and be grateful for what he's got away with.

It's hardly the crime of the century, especially as this was on a new bike. Not a habit.

It just makes me laugh to see people chastise people for breaches of the road traffic act when they themselves regularly contravene traffic law.

I'm assuming you don't obey all the rules of the road? Waste of a 999 if you do
