Re: Bye bye License.
Mate if you go to court then at least you have a chance to tell them why you should keep your licence, because you need it for work etc.
As for taking the ban instead of the points, i would prob take the points tbh as i believe you have to declare the last 10 years disqualifications to the insurance companies but only the last 5 years points.
I cant stand the Criminal Justice System its so unfair in the way it works, in London they would prob give you 3 points for that but once you get out in the counties your fecked there is no consistency anymore.
Chin up mate i dont think you will get banned unless you accept a ban instead of points

Re: Bye bye License.
You can't chose a ban or points, it's up to the magistrates court at the time.
Personally I wanted points, however it all worked out fine, not sure you need to declare bans for then next 10 years for insurance purposes though, all they've ever asked me for is motoring convictions & accidents in the past 5 years.
No matter what you'll be fine, in the end it'll be two weeks max but most likely points and a stern lecture.

I got caught doing 67mph on a dual carriageway in North London in 2000, turns out it was a 30mph limit with no signs.SlowR1der wrote:As for taking the ban instead of the points, i would prob take the points tbh as i believe you have to declare the last 10 years disqualifications to the insurance companies but only the last 5 years points.

I went to court with a letter from my employer explaining my need for a licence, a map showing the remote village in Somerset where I lived, a copy of the non existant bus timetables which proved my inability to pay my mortgage without a licence, so I was confident of points not a ban.
Turns out the local magistrate lived just off the dual carriageway. I got banned for 2 months, which got reduced to 3 weeks when I protested in court, £185 fine, and then the C U N T magistrate laughed as he pointed out that I could not drive the 130 miles home in my car (which was parked in a multi-storey car park round the corner), and that the train drivers were striking at the time.
As you can imagine, any faith and trust I had in this country's justice system evaporated right there, and 9 years later I am still angry about it, and have no faith in the system.
The ban only stayed on my licence 5 years though.
In short, get yourself a soliciter now, as in the eyes of the law you are criminal scum, and they will [censored] you right up.

Re: Bye bye License.
Apparently they didnt even bother looking at my statement of events, which is a complete waste of time, as surely they could had read what I had to say then if they still felt I deserved a ban arranged for another hearing... but atleast they're contemplating a ban without the facts and hopefully once given the reasons why, they'll go lightly on me (yeah right
)
Although a very short ban and clean license sounds good but I will still take points any day of the week just out of principle, because I don't personally feel I deserve to be banned.
As for the hearing, I'm going as myself - jeans, t-shirt and probably unshaved. I'll tell the truth as it happened and just see what happens. I might even mug an old lady too.
I'm having an all or nothing year. Never once went wide or went onto the grass on track but get spat off at 80MPH then get caught speeding once and lose my license.

Then you will get shafted its not about who you realy are its about who they think you are. Trust me I have 15 speeding convictions and 2 bans, get a brief or use the duty brief (its free) let him talk for you, look sorry and present yourself as best you can, if you make the effort you will have a better chance.

Typical of this politically correct, morally incorrect nanny state. What a bunch of complete to##ers we have in charge of this country. Has anyone from the government been charged with their fraudulent claims yet! They never take your past driving history into account, if you have a clean licence that is. The whole justice system is wrong. I hope you get a good brief and a Judge who has common sense.
